    PUBLIC NOTICE

    Subject: PURCHASE OF CARS HAVING ENGINE CAPACITY UPTO 1300CC BY PHYSICAL DISABLED PERSONS ON CONCESSIONAL CUSTOMS DUTIES.

    No.11 (289)/2002-R.O.(IMP-II): The following regulatory procedure is prescribed in order to facilitate the purchase of cars by the disabled persons at concessional rate of customs-duties, namely:-
    A disabled person (excluding mentally retarded and those disabled by extreme old age) desirous of availing the facility under this scheme shall send an application to the Deputy Secretary (Imports), Ministry of Commerce giving his complete business and residential addresses with telephone/fax numbers temporary and permanent if any.
    (ii) The application mentioned in above shall be neatly typed, clearly describing the disability of the applicant, the make model and engine capacity of the vehicle he is interested to buy and the nature of disability gadgets he may require to compensate his disability;
    (iii) He shall also specify whether he has or has not availed the facility previously. If he has availed the facility previously, he shall specify the make, model and engine capacity of the car, describe the disability gadgets he is using, and the number of times he has availed the facility with dates of purchase of each car;
    (iv) The applicant shall declare whether or not he is registered as a disabled person with the District Assessment Board of the Social Welfare Department of the district/province of his residence; and
    (v) He shall disclose his personal income as declared to the Income Tax authority. If the personal income of a disabled person is less than Rs.10, 000/- per month, the Board can reject the request because it is difficult to maintain a car with less than Rs.10, 000/- per month income. A rich disabled person with income above Rs.50, 000/- per month will not be eligible under the scheme.

    2. If a reasonable number of applications (not less than 20) are received from a particular region, the Deputy Secretary (Imports), Ministry of Commerce, will arrange a meeting of the Board at a focal city of the region i.e. the Provincial capital. If the number of applications is less than 20, the applicants may be called to an adjacent focal city where the number of applications could be more to justify holding of the Board meeting.

    3. Call letters will be issued to applicants at least 15 days before the scheduled date of the Board meeting. The time of interview should also be properly regulated, in such a way that all the applicants are not called at the same time. Their timing of interview has to be suitably staggered in order to reduce their waiting time.

    4. The applicants will be required to submit the following documents for examination of the Board on retention for record by Ministry of Commerce at the time of interview namely: -

    1. Sufficient and conclusive evidence/proof in the form of annual income tax return filed showing that the income of the applicant is within the lower and upper limits given at para 1(v) above.

    2. NTN issued by the Income Tax Department.

    3. Medical certificates X-ray, and any other necessary documents to prove the disability; and

    4. Valid driving licence in the name of the disabled applicant. (The Federal Board may waive off the condition of valid driving licence if a person is invalid by birth.

    5. Valid departmental permission to purchase and maintain a car in case the applicant is a government servant.

    6. Disability certificate from District Assessment Board of the Social Welfare Department if registered with DAB.

    5. The Federal Board will comprise Senior Joint Secretary/Joint Secretary (Imports) and Deputy Secretary (Imports) of Ministry of Commerce, middle management level representatives of Ministry of Social Welfare and Ministry of Finance (CBR) and an Orthopedic Surgeon nominated by Ministry of Health. Senior Joint Secretary/Joint Secretary (Imports) will act as the Chairman of the Board; Deputy Secretary (Imports) will act as Secretary of the Board.

    6. The Board will interview each applicant with reference to his disability, recommend the type of vehicle, and the gadgets required to compensate the specific disabilities, and assess their financial position. The Board may like to examine any other aspect of the applicant, which the Board may consider to be relevant to the finalization of a decision about the entitlement or other wise of an applicant.

    7. After interview of the applicant and examining the facts, the Board may accept, reject or defer the case. In case of acceptance, the type of vehicle and the special gadgets required to compensate the disability of the applicant will be prescribed in cases requiring such a prescription. Recommendations of the Board will be recorded in the minutes of the meeting. In cases approved by the Board, the applicants will be required to supply an affidavit on stamp paper within a period of two weeks to the following effect namely:-

    that the car to be purchased under this scheme will be used exclusively by the disabled applicant and that the person has not purchased a car under the scheme during the last 5 years.

    (ii) that he will get the prescribed gadgets fixed in the car, if the facility of fitting gadget(s) is not available with the local assemblers/manufacturers of cars; and

    (iii) the applicant will also clearly undertake that he understands and will comply with the terms and conditions of this scheme.

    8. On receipt of the documents prescribed in para 7 above, Ministry of Commerce will issue a purchase authorization in accordance with the recommendations of the Board. The purchase authorization will be subject to the following conditionalities: -
    Sale, transfer or alienation of the car purchased under this scheme will not be permissible in any manner for a period of five years from the date of its purchase except:-
    To a disabled person on production of a valid purchase authorization from Ministry of Commerce after recommendation of the Board;
    In case of death of a disabled person owning a car purchased under this Scheme, by any of his legal heirs to any person in accordance with the condition specified in above;
    To any other person on payment of the same amount of customs duties and taxes which were exempted on the car at the time of its original purchase.

    (ii) No customs duty or sales tax shall be payable if the vehicle is sold or transferred after the expiry of five years from the date of its purchase under this scheme;
    (iii) The facility to purchase a car under the scheme will be available only once in five years. In case of an accident before expiry of five years, a certificate from the concerned Provincial Excise and Taxation Department alongwith a copy of FIR shall be produced certifying that the car purchased earlier has been rendered useless and irreparable in order to enable the Board to examine the cases for authorizing the purchase of a replacement;
    (iv) Cars purchased by disabled persons under this scheme will carry a special Registration Number and Special Colour Plates mentioning “Disabled Person’s Car”. The Provincial Excise and Taxation Departments will ensure provision of such Registration Numbers and Number Plates;
    (v) Only the disabled person or any other person will drive the car specifically so authorized by the Board.
    (vi) After purchase of car under the scheme, the concerned disabled person will furnish a copy of purchase receipt and registration certificate of the car to the Deputy Secretary (Imports), Ministry of Commerce within a reasonable period of time not exceeding three months from the date of purchase;
    (vii) Maximum engine capacity of cars variation under this Scheme will be 1300CC However, is ignorable of upto 50CC engine capacity; and
    (viii) The purchase authorization will be valid for one year from the date of its issuance.
    (ix) Mentally retarded and persons physical disabled by old age and who can not drive cars by themselves will not be entitled to concession under this scheme.
    Cars purchased under this scheme will not be used for Commercial purpose.

    9. In case of rejection of an application the applicant can file a review petition before the Board. The board will examine the case in a subsequent meeting the light of fresh grounds submitted by the applicant and take a decision. The decision of the Board will be final.

    10. If any abuse is observed by Police Department, the Excise and Taxation Department or Customs Department, they will be under obligation to report it to Deputy Secretary (Import), Ministry of Commerce.
